Rates and the small print

Rates:

Our rates for the 2010 season are as follows:

$160.00 per night or $1100.00 per week.

(These rates may vary based on the number of persons occupying the premises.)

Discounts are available for longer stays.

Rentals generally run from Saturday at 3:00 p.m. until Saturday at 10:00 a.m.

Linen is not normally provided but may be provided for a nominal fee.

Family friendly philosophy:

Please be aware that Far Niente is a family-oriented property.  Parties of a loud nature are discouraged. Renters are required to act in a manner respectful of our property and our neighbours at all times. We expect that our renters will leave the cottage in the same condition it was in at the time of check-in.  Renters are responsible for the cleaning of the cottage and the removal of all garbage and recycling.

Payment:

Booking must be confirmed in writing with 50% as a deposit.  Until a deposit is received, no reservation has been made. A security deposit of $250.00  is also payable upon booking and is fully refundable provided no damage has been done to the property or contents, no additional cleaning is required, and the keys have been returned.

The balance is due and payable prior to arrival by international money order, traveller's cheque, certified cheque or bank draft.  Payments are payable to Paul Smyth and are to be sent to 13931 Morris Road, R R # 4 Welland, Ontario L3B 5N7. The full rental amount is due thirty (30) days prior to check-in.  Keys will not be provided until payment is made in full.

Cancellation:

Any cancellation by the renter must be made in writing 30 days in advance of the rental period. If written cancellation is made more than thirty days prior to the first day of the stay, all monies will be returned less a $75.00 cancellation fee for each week booked. If written cancellation is received less than thirty days prior to the first day of the stay, all monies will be forfeited.  If we are successful in rebooking the accommodation for the period of the cancelled booking, we will refund payment less the $75.00 cancellation fee.  If we are unable to rebook, all monies paid will be forfeited.

Representation:

The information provided herein is accurate at the time of publication. We reserve the right to make changes as necessary to accurately reflect the cottage property. For example, televisions and DVD players are supplied at the discretion of the owner as an added feature for our guests.  While every attempt will be made to ensure that everything is in working order for our guests, should a breakdown occur whereby the items are not available for the full term of the rental period, (and while we will make every effort to respond) we cannot take responsibility for replacing or refunding the guests for the lack of use of these elements.  It is agreed that the Owners and their representatives may enter the premises during the leased period for the purpose of clean-up, repair and general maintenance.

Occupancy:

We ask for information about our renters on the application form. Sub-letting is not permitted.  The maximum occupancy must be strictly observed.  Exceeding this occupancy is grounds for eviction without refund.  Additional guests must have prior authorization and may be subject to additional fees.  The renter agrees that (s)he will not permit the use of the premises for any unlawful or disorderly purposes, nor commit or permit a nuisance to be permitted therein.  No firearms, explosives or fireworks of any kind are permitted.

Pets and smoking:

We do have a strict no pets and no smoking policy.  If pets are discovered, any and all pet damages will be charged to the renter and the renter will be evicted immedately and security deposit forfeited.  Any evidence that smoking has taken place will result in immediate eviction. (Please keep in mind that while this is the case it does not mean that there have never been pets or smoking in the past. Guests with allergies should be aware of this fact.)

Liability:

Far Niente Cottage Owners will not be responsible or liable for any consequential damages, injury, loss or expense arising out of or in connection with the use of the rental property or the inability to use the rental property for any reason.  The parties agree that this rental contract will be governed by the laws of the Province of Ontario.  Renters agree to abide by the jurisdiction of the courts of the Province of Ontario with respect to any and all disputes arising out of the interpretation and application of this contract and the relationship between Far Niente Cottage and the renter.
